Terms of the “Angler Club” Loyalty Programme
Terms of the “Angler Club” Loyalty Programme
Version 1.1
Effective date: 16.10.2026
§ 1. Organiser and contact
- The “Angler Club” Loyalty Programme is organised by JURASSIC LURES TOMASZ KOTARSKI, ul. Grunwaldzka 18, 42-226 Częstochowa, Poland, NIP 9492069455, REGON 540829915, operating the Jurassic Lures shop and using the Jurassic Lures brand, hereinafter the “Organiser”.
- For Programme matters, contact us by email at tom@tkart.eu or by telephone on +48 669 218 576, Monday to Friday, 9:00–17:00.
- These Terms govern participation in the Programme, the award, correction and redemption of Points, ordering Rewards, submitting catch photos and making complaints.
§ 2. Definitions
- Programme – the “Angler Club” loyalty programme operated by the Organiser in the Jurassic Lures shop.
- Participant – an adult natural person who has joined the Programme on the conditions set out in these Terms.
- Account – an individual customer account in the Jurassic Lures shop linked to Points, photo submissions and transaction history.
- Points – Programme accounting units which are neither electronic money, a means of payment nor a right to a cash payout.
- Submission – a catch photo together with information supplied by the Participant, submitted for manual review.
- Material – the photo and related information included in a Submission.
- Reward – a product listed in the current Rewards Catalogue which the Participant may order in exchange for Points.
- Rewards Catalogue – the current list of products, sizes, variants, availability and Points costs displayed in the Programme.
§ 3. Participation conditions
- Participation is voluntary and no membership fee is charged.
- An adult with a valid email address may become a Participant. A Submission may be sent as a guest without creating an Account, by providing an email address. Claiming Points and ordering Rewards requires an active Account and verification of the email address. One person may use one Account in the Programme.
- A person joins the Programme by accepting these Terms in the Programme form. If purchase Points were technically recorded earlier, submitting a Submission or ordering a Reward requires prior acceptance of the current version of these Terms.
- The Participant must provide truthful, current and non-misleading information and protect their Account login details.
- The Programme is intended for retail customers. A person purchasing in connection with a business may participate unless the Organiser has excluded that possibility, taking account of different tax obligations relating to Rewards.
- Automated Account creation, trading in Points, providing paid access to an Account and using the Programme contrary to its purpose are prohibited.
§ 4. Ways of earning Points
- Points may be awarded:
- for purchasing selected Jurassic Lures products;
- for a Submission approved following manual review;
- through a documented adjustment made by the Organiser;
- under a separate promotion whose rules expressly provide for awarding Points.
- The current Points awarded for purchasing one unit of a product are displayed in the shop or follow from an active rule for the model and size. If no separate rule applies to a product, the current default value indicated in the Programme applies.
- Purchase Points are credited after the order has been paid or processing has begun. A product ordered as a Reward at PLN 0 does not generate purchase Points.
- Purchase Points are calculated for each unit purchased. Delivery costs, payment charges and other additional fees do not increase the number of Points.
- If an order is cancelled, payment fails, the customer withdraws from the contract or a product is returned, the Points awarded for that product will be reversed. For partial returns, the reversal is proportional to the number of units returned.
- If the Participant used Points before their reversal, the balance may become negative. Further Rewards cannot be ordered until the balance is replenished.
- Points associated with a guest order may await activation against the email address used for that order. Allocating them to an Account requires creating an Account with the same email address, verifying that address and meeting the current Programme conditions.
§ 5. Catch photo Submissions
- A Submission must show a genuine catch made using a Jurassic Lures lure and allow a reliable assessment of the fish and lure used.
- The form may require the model and product, lure size, fish species and length, country or fishing venue, and one JPG, PNG or WEBP file not exceeding the size limit stated in the form.
- A photo may be submitted only once. The system may block identical files and limit the number of Submissions awaiting review.
- Materials must not be submitted if they:
- belong to someone else, were generated by AI, were manipulated in a way that changes the true circumstances of the catch, or were previously submitted by another person;
- infringe copyright, personal interests, privacy, likeness rights, trademarks or other third-party rights;
- show illegal, grossly unethical or inhumane conduct, or conduct contrary to fish protection rules applicable at the place of the catch;
- contain offensive, discriminatory, pornographic, graphic, advertising or misleading content, or third-party data unnecessary for the Submission;
- show an identifiable minor, unless their legal representative has given the Organiser documented permission required for publication.
- Before submitting, the Participant should remove location data or other metadata they do not wish to disclose. The Organiser may additionally remove technical metadata while processing the photo.
- Detailed rules on rights to the Material, the licence and likeness are set out in “Photo submission rules, licence and likeness”, which forms an integral part of these Terms.
§ 6. Submission review and photo Points
- Every Submission is reviewed manually. Its status remains pending until review is complete.
- The Organiser may approve or reject a Submission, determine the number of Points or request further explanations.
- The Organiser considers in particular authenticity, image sharpness and clarity, visibility of the fish and Jurassic Lures lure, completeness of information, compliance with these Terms and the Material’s usefulness to the brand community.
- An approved Submission earns the Points indicated on the Programme page when it is sent. Material of exceptional quality may earn more Points, up to the current maximum displayed in the Programme.
- Sending a Submission alone does not guarantee Points or publication of the Material.
- The Participant may be informed of the review outcome by email and through the Account. The Organiser may give a reason for rejection.
- Changing a previously approved Submission to rejected, particularly after discovering infringement of third-party rights or fraud, results in reversal of the Points awarded for it.
- Approval may result in publication in the community gallery and use under the licence and permission relating to likeness. The Organiser is not obliged to publish every approved Material.
§ 7. Points balance and validity
- The current balance and transaction history are available after logging into the Account.
- Points are assigned to the Participant. They may not be sold, transferred, split between Accounts, exchanged for cash or used outside the Programme.
- Points do not expire while the Programme continues, provided the Account remains active and there are no grounds for reversal under these Terms.
- In the event of an obvious technical error, the Organiser may correct the balance after explaining the transaction and leaving a record in the Points history.
- The Participant should report any balance discrepancy without undue delay. Failure to report immediately does not deprive a consumer of rights arising from mandatory law.
§ 8. Rewards Catalogue and Points cost
- The Rewards Catalogue is dynamic. The Organiser may add and remove products, change availability and set Points costs for the future.
- The cost of a Reward depends on the combination of product model or category and size. A colour or other visual variant of the same model and size does not change the cost unless expressly stated otherwise.
- The binding cost is the cost displayed for the product when the Reward is successfully added to the cart. A cost change does not affect a Reward order already correctly created.
- Rewards are available while stocks last. Displaying a product in the Catalogue does not guarantee its availability until the order is created.
§ 9. Ordering Rewards
- The Participant selects a specific Reward product or variant and adds it to the standard WooCommerce cart with a product price of PLN 0 and the stated Points cost.
- The Participant may add several different Rewards if the balance is sufficient. Each specific Reward may appear in the cart only once.
- Points are not irreversibly deducted merely by clicking a button. They are reserved only after an order is successfully created.
- Once the order has been paid or processing has begun, the Points reservation is settled. If the order is cancelled, payment fails or the order is fully refunded, Points used for Rewards automatically return to the Account.
- If a Reward becomes unavailable after the order is created, the Organiser will propose an appropriate solution, in particular another variant with the Participant’s consent or cancellation of the Reward and return of Points.
- The Reward product is free of charge, but delivery may be charged as indicated in the cart and under the shop’s current delivery rules, unless the Organiser expressly provides free delivery.
- The Jurassic Lures shop terms also apply to fulfilment of Reward orders, delivery, product complaints and consumer rights. These Terms do not limit statutory consumer rights, including rights concerning lack of conformity and withdrawal from the contract, where applicable.
§ 10. Abuse and suspension
- The Organiser may temporarily suspend Points settlement or Reward ordering where there are specific grounds to suspect fraud, infringement of third-party rights, manipulation of Submissions, exploitation of a technical error or Account takeover.
- Before permanently reversing Points or excluding someone from the Programme, the Organiser will inform the Participant of the reason and allow explanations, unless immediate action is necessary to protect security or third-party rights.
- The measures taken must be proportionate to the infringement. The Participant may complain about any decision concerning their Account, Points or Submission.
§ 11. Withdrawal and Programme termination
- The Participant may leave the Programme at any time by contacting the Organiser. Leaving does not require deletion of the shop Account if the Participant wishes to continue using it outside the Programme.
- Leaving results in loss of unused Points after confirmation by the Organiser, unless the Participant and Organiser agree on prior redemption.
- The Organiser may terminate the Programme for important business, legal or technical reasons, notifying Participants at least 30 days in advance through the Programme page and the email address associated with the Account.
- If the Programme ends, Participants retain the ability to redeem correctly accumulated Points for at least 30 days from the date stated in the notice, subject to Reward availability.
§ 12. Complaints
- Programme complaints may be submitted by email to tom@tkart.eu or in writing to the Organiser’s address.
- Where possible, a complaint should include information identifying the Account, order or Submission number, a description of the problem and the desired solution. Missing some information does not automatically result in rejection.
- The Organiser will respond without undue delay, within 14 days of receipt at the latest, unless mandatory law provides a period more favourable to the consumer.
- Consumers may obtain free assistance from a municipal or district consumer ombudsman, the Trade Inspection or information available at prawakonsumenta.uokik.gov.pl.
§ 13. Personal data
- Personal data processing in the Programme is described in the separate “GDPR privacy notice – Angler Club”.
- Submitted Material may be made public within the scope of the licence and likeness permission. Before sending a photo, the Participant should consider the consequences of public publication.
§ 14. Changes to the Terms
- The Organiser may amend these Terms for important reasons, particularly changes in law, authority decisions, development or limitation of Programme functions, improving security, preventing abuse or changes to Rewards Catalogue rules.
- The Organiser will announce amendments at least 14 days in advance on the Programme page and by email, unless earlier entry into force is required by law or an urgent security threat.
- Changes do not prejudice rights acquired before their entry into force. If a change materially affects the Participant’s rights and obligations, further use of the relevant Programme function will require acceptance of the new version.
- A Participant who does not accept the changes may leave the Programme before they take effect.
§ 15. Final provisions
- These Terms are available free of charge in a form that can be saved and reproduced. The Organiser retains archived versions.
- Polish law applies to matters not covered, provided that the choice of law does not deprive consumers of protection under mandatory provisions of their country of habitual residence.
- Disputes will be resolved by the competent court determined under applicable law. These Terms do not impose a court on consumers that lacks jurisdiction under the law.
- The following form an integral part of the Programme rules:
- “Photo submission rules, licence and likeness – Angler Club”;
- “GDPR privacy notice – Angler Club”;
- the Jurassic Lures shop terms regarding orders, delivery and consumer rights.
Photo submission rules, licence and likeness – Angler Club
Version 1.1
Effective date: 16.10.2026
1. Purpose
This document sets out rights to photos and information submitted in the “Angler Club” Programme, the scope of the licence granted to the Organiser and rules for publishing the likeness of people shown in photos. It forms an integral part of the Programme Terms.
2. Statements of the person submitting Material
- By submitting Material, the Participant declares that:
- they took the photo or obtained effective authorisation from its author to grant the Organiser the licence described below;
- the Material is genuine and has not been generated by AI or altered in a manner misleading viewers about the catch, fish or lure used;
- the Material does not infringe copyright, personal interests, privacy, likeness rights, trademarks or other third-party rights;
- they obtained every identifiable person’s permission to submit the Material to the Organiser and publish it within the scope described in this document;
- if a minor is visible, they hold demonstrable permission from the minor’s legal representative covering publication by the Organiser;
- the information accompanying the photo is truthful and does not disclose third-party data without a legal basis.
- The Organiser may request proof of authorship, the original file, permission from a person shown in the photo or permission from a minor’s legal representative.
- If the Participant cannot demonstrate the required rights or permissions, the Organiser may reject the Submission, remove the Material from publication and reverse the Points awarded for it.
3. Grant of a licence to the Material
- Upon sending a Submission, the Participant grants the Organiser a non-exclusive licence to use the Material for 10 years, worldwide, for operating the Programme, presenting the angling community and promoting the Jurassic Lures brand and products.
- The licence covers the following fields of use:
- fixing and reproducing the Material by any technique, particularly digital, photographic, printing and reprographic techniques;
- storing it in computers, servers, content management systems, databases, backups and mobile devices;
- public exhibition, display, playback and presentation;
- making it publicly available so that anyone can access it at a place and time of their choosing, particularly on Jurassic Lures shop websites, in the online shop, community gallery, Jurassic Lures profiles and advertisements on Facebook, Instagram and YouTube, and other official online brand channels;
- use in newsletters, emails, catalogues, leaflets, posters, exhibition materials, presentations, product instructions and other Organiser promotional materials;
- combining the Material with a product name, logo, catch description, caption, translation, graphic elements and other Materials, respecting the author’s moral rights.
- The Participant permits technical adaptation necessary for publication, particularly cropping, resizing, format changes, compression, brightness and colour correction, adding a caption, brand mark or translation. Changes must not present the Participant, catch or product in a false or degrading context.
- The Organiser may sublicense only to entities providing its marketing, printing, hosting, social media or Material distribution services, and only to the extent necessary for the purposes described above.
- The licence is granted without separate monetary remuneration. Points awarded under the Programme are a benefit associated with a Submission and are not payment for each specific use of the Material.
- The licence is non-exclusive, so the Participant retains the right to use the Material and grant rights to others, provided this does not infringe rights previously acquired by the Organiser.
4. Authorship and attribution
- The photo author retains their moral rights.
- The Participant permits distribution without identifying the author by first and last name. The Organiser may disclose a first name, pseudonym or social profile only if supplied for publication or separately accepted by the Participant.
- The Organiser may not attribute authorship to another person.
5. The Participant’s likeness
- If the Participant is identifiable in the Material, they permit the Organiser to record and distribute their likeness free of charge as part of the Material for 10 years, worldwide, for the purposes and channels described in section 3.
- Permission covers the technical photo adaptations described in section 3(3), but excludes offensive, discriminatory, political or erotic contexts or suggestions of personal endorsement unrelated to the actual catch.
- The Participant may request an end to future distribution of their likeness at any time by writing to tom@tkart.eu. Withdrawal of permission does not affect the lawfulness of earlier publications. The Organiser will cease new publications and remove the Material within a reasonable time from channels under its direct control, unless retention is necessary to establish, exercise or defend claims.
- Withdrawing likeness permission does not automatically forfeit Points correctly awarded earlier, unless the Participant’s original statement was false or infringed a third party’s rights.
6. Third-party likeness and rights
- The Participant may not grant permission on another person’s behalf without authorisation. For photos showing other identifiable people, the Participant is responsible for obtaining permissions appropriate to the planned publication.
- At the request of a person shown, the Organiser will verify the basis for publication and may temporarily hide the Material while clarifying the matter.
- The safest option is to submit photos without identifiable third parties or minors, unless the Participant holds documented permission.
7. Publication and removal of Material
- The Organiser decides whether and when to publish approved Material. Awarding Points does not guarantee publication.
- The Organiser may end publication at any time, particularly for editorial, technical or legal reasons or at the justified request of a person whose rights are concerned.
- Removal from the Organiser’s channels does not guarantee removal of copies previously saved or shared by independent internet users. However, the Organiser will not republish withdrawn Material after likeness permission has been effectively withdrawn.
8. Reporting infringement
Anyone who believes Material infringes their rights may write to tom@tkart.eu, identifying the Material, nature of the infringement and information allowing verification of the request. The Organiser will consider the report without undue delay and may temporarily hide the Material during clarification.

6. Transfers outside the European Economic Area
Online and social media service providers may process data outside the European Economic Area. Such transfers use a mechanism permitted by the GDPR, particularly a European Commission adequacy decision or standard contractual clauses, depending on the provider’s arrangements. Details of a social platform’s processing are in its privacy policy.
7. Retention periods
- Account data, Points balance and history are retained for participation and then as needed for Programme settlement and limitation periods, generally no longer than 6 years from the end of the year in which participation ended or the last transaction requiring settlement took place.
- Order data is retained for periods required by tax, accounting and consumer law and until related claims become time-barred.
- Pending Submissions are retained until review is complete and for the time needed for complaints and investigation of possible abuse.
- The Organiser manually deletes or anonymises rejected photos no later than 12 months after final review, unless longer retention is necessary for complaints, third-party rights, demonstrating abuse or defending claims. The system does not guarantee automatic deletion after that period.
- Approved unpublished Material is retained during participation and the licence term, unless it ceases to be needed for Programme purposes earlier.
- Published Material and licence and likeness permission records are retained for the term of the granted rights and then the limitation period. After effective withdrawal of likeness consent, the Organiser ceases new publications and removes Material from directly controlled channels within a reasonable time, subject to archived copies and data necessary to defend claims.

- We do not make decisions based solely on automated processing that produce legal or similarly significant effects on Participants within the meaning of Article 22 GDPR.
- A human decides whether to approve or reject a photo and the Points awarded for a Submission.
